1. Acceptance of Terms
These Terms of Service ("Agreement") constitute a legally binding contract between OsciWave ("Company", "we", "our") and the individual or legal entity ("Customer", "you", "your") accessing or using the OsciWave WebSocket broadcasting engine, client SDKs, REST APIs, or administration panel.
By creating an account, generating API credentials, or establishing a WebSocket connection to our cluster, you agree to be bound by all terms, policies, and operational rules referenced herein.
2. Platform Provision & Capacity Enforcements
OsciWave provides high-performance, sub-millisecond WebSocket event broadcasting infrastructure compatible with standard Pusher and Laravel Echo client libraries.
- Concurrent Connection Slots: Plan tiers govern maximum allowed simultaneous active WebSocket sockets (Free: 100, Starter: 500, Pro: 1,500, Scale: 3,000).
- Quota Rejection: Incoming connection handshakes attempting to exceed your active subscription slot allocation will be refused with WebSocket close code `4100` (Over Quota).
- Unlimited Messages: OsciWave imposes zero caps on total broadcasted payload volume or event frequency across active channels within your slot limit.
3. Acceptable Use Policy
You agree not to misuse or facilitate the misuse of OsciWave infrastructure. Prohibited activities include, but are not limited to:
A. Malicious Broadcasting
Broadcasting computer viruses, trojans, ransomware, or payloads designed to exploit client vulnerability or launch distributed denial-of-service (DDoS) attacks.
B. System Reverse Engineering
Decompiling, reverse-engineering, or attempting to derive underlying socket server kernel algorithms or proprietary cluster routing logic.
C. Authentication Bypass
Forging private or presence channel HMAC signatures or circumventing API key authorization mechanisms.
D. Unlawful Content
Transmitting content that infringes third-party intellectual property or violates national data privacy statutes.
4. API Credentials & Security Responsibilities
Upon account activation, you will generate unique API credentials (`App ID`, `App Key`, `App Secret`). You are solely responsible for maintaining the confidentiality of secret keys and restricting access to authorized server applications.
You accept full financial and legal responsibility for all broadcasts and socket connections initiated using your credentials. In the event of secret key compromise, you must immediately revoke the affected key via the OsciWave dashboard.
5. Subscriptions & Billing Terms
OsciWave services are billed in advance on a recurring monthly or annual subscription cycle via our Merchant of Record, Creem.
- Automatic Renewal: Subscriptions renew automatically at the end of each billing cycle unless canceled prior to the renewal date.
- Upgrades & Downgrades: Upgrading your plan tier takes effect immediately with prorated charge calculations applied by Creem.
- Refund Policy: All subscription payments are non-refundable except where required by mandatory consumer protection legislation.
6. Service Level Agreement (SLA) & Uptime Guarantee
For Pro and Scale subscription plans, OsciWave target availability is 99.99% operational uptime per calendar month, excluding scheduled maintenance windows announced at least 48 hours in advance.
7. Intellectual Property Rights
OsciWave retains all right, title, and interest in and to the platform architecture, trademarks, documentation, and underlying code. You retain full ownership of all data payloads transmitted through your application channels.
8. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall OsciWave or its officers be liable for indirect, punitive, incidental, special, or consequential damages, including loss of profits, lost data, or business interruption arising from socket disconnection or broadcast failure.
9. Suspension & Termination
We reserve the right to suspend or revoke API credentials immediately and without prior notice in the event of a critical security incident, non-payment, or material violation of these Terms.
